What Is a Juvenile Risk Assessment, and How Do Probation Algorithms Affect Your Teen’s Case in Orange County?

A juvenile risk assessment is a scored questionnaire that a probation officer completes about your child, and it shapes what probation recommends rather than what the court decides. If the words low, moderate or high risk in a probation report landed like a verdict, it is not one.

What Is a Juvenile Risk Assessment, and Who Scores It?

A juvenile risk assessment is completed by a probation officer, not by the judge and not by the prosecutor. That officer works through a standardized set of questions and assigns points, and the total places a young person in a risk category.

The questions usually cover:

  • Prior referrals to probation
  • School attendance and performance
  • Supervision and stability at home
  • Who a teen spends time with
  • Any substance use
  • Attitudes recorded during the interview

Much of what gets scored describes circumstances a young person did not choose, which is one reason the number deserves scrutiny.

How Does the Score Affect My Teen’s Case?

A risk score affects a teenager’s case at two separate points, and neither of them is the finding on the charge itself. Early on, it can inform whether a young person is detained or released to a parent after a referral, a decision governed by Welfare and Institutions Code Section 628. Later, it travels inside the probation report the court considers at disposition under Section 706 before deciding on placement or probation terms under Section 730.

The distinction that matters to parents is this. The score produces a recommendation. The judge makes the decision, and the court is not bound by the number.

Can a Risk Score Be Wrong, and Can We Challenge It?

A juvenile risk score can absolutely be wrong, and it can be challenged, because the score is built from records and interview answers and both can be inaccurate. Prior referral entries can be wrong. A school record can show absences that were approved. An interview may have happened before your family had a chance to speak with us.

We can request the completed assessment, identify factual inputs that are incorrect, supply context the scoring leaves out, and put independent evidence before the court, such as counseling enrollment, improved grades or steady employment, so the case stays focused on rehabilitation rather than punishment. Researchers and advocates have also raised broader questions about whether these instruments can reproduce existing disparities, and that concern is a fair one to raise.
