Can Teens Be Charged for Attending a Street Takeover in California?
No California statute makes watching a street takeover a crime. Two Orange County cities make it a local offense anyway, and a city ordinance violation can support a juvenile petition.

Is Watching a Street Takeover Illegal in California?
State law reaches drivers and helpers, not onlookers. Vehicle Code 23109 bars engaging in or aiding and abetting a speed contest or exhibition of speed, and bars blocking a street to facilitate one. The word spectator appears there only inside the definition of a sideshow, which the statute says “is also known as a street takeover,” describing the audience rather than an offense.
Two Orange County cities filled that gap, and their ordinances work the same way.
- Anaheim Municipal Code 14.70.040 makes it unlawful to knowingly be a spectator at a street race or reckless driving exhibition, with present defined as within 200 feet.
- Newport Beach Municipal Code 12.70.030, adopted in 2025, uses the same knowing standard and the same 200-foot line.
Both cities allow prior racing involvement, the time of day, and where a person stood to be used as proof. The 200 feet is the detail worth knowing in advance.
When Can a Teen Who Was Only Watching Be Charged?
Presence is not participation, and California law draws that line carefully. Penal Code 31 makes anyone who aids and abets a principal in the crime, but under People v. Beeman the prosecution must prove knowledge of the unlawful purpose plus the intent to encourage or facilitate it.
In practice that separates two very different teenagers. One blocked an intersection, watched for police, filmed to promote the event, or helped pick the location. The other heard engines and walked over. The first faces real exposure, including a conspiracy allegation under Penal Code 182 if group messages show an agreement. The second does not, and an Orange County juvenile defense attorney says so in writing early, which is often the whole defense.
What Happens to the Teen and to the Family Car?
Juvenile cases start differently. Welfare and Institutions Code 650 has the district attorney commence the matter by filing a petition, and Welfare and Institutions Code 602 gives the court jurisdiction over state law and city ordinance violations, with an age-based curfew ordinance expressly carved out.
The realistic outcome sits before a hearing. Welfare and Institutions Code 654 lets probation order up to six months of supervision instead of filing anything, with the consent of the teen and a parent, and diversion programs run along the same track.
The family car is at more risk than the teen’s license. Under Vehicle Code 23109.2 an officer may seize the vehicle used in the offense and impound it for up to 30 days, with towing and storage falling on the registered owner. License suspension tied to sideshow exhibition of speed convictions does not begin until January 1, 2029. Aiding and abetting under section 23109 tops out at 90 days and a $500 fine, while the underlying vehicle offenses carry more.
These events run late, so the citation a purely watching teen most often receives is a curfew violation rather than anything about racing.
