Penal Code 192(c)
Vehicular Manslaughter occurs when you are driving a vehicle and get into an accident and kill another person. The penalties depend on whether or not drugs or alcohol was involved, and whether or not you were driving in a negligent manner or in a grossly negligent manner. The penalties range from a low of up to one year in the county jail with a maximum of up to 10 years in the state prison for Aggravated Vehicular Manslaughter. If you have been convicted of a DUI and drive again while under the influence of alcohol and drugs and kill someone you can be prosecuted for 2nd degree murder.
Charges of a vehicular manslaughter are very serious. If you are charged with vehicular manslaughter, you should seek to retain counsel as soon as possible. If you left the scene of an accident, and you believe someone may have been hurt or killed, you should seek counsel from an experienced attorney right away. The sooner you seek counsel, the better your chances are for a more favorable outcome.
